YOU UNDERSTAND THAT BY CHECKING THE BOX AND CLICKING THE “ACCEPT” BUTTON, YOU ARE AGREEING TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS”). IF YOU DO NOT AGREE YOU SHOULD NOT CREATE AN ACCOUNT.
These Terms apply to all individuals ("Users") who create an account on this website or application (the “Site”).
The words “we”, “us” and “our” means the owner of this Site, Locality Media, Inc. The words “you” and “your” refers to the User or person accessing or using the User’s account.
TERMS OF SERVICE / YOUR PERSONAL INFORMATION
We may assign you a User ID and password. The User is solely responsible for ensuring and maintaining the secrecy and security of the User’s login credentials. We will not be liable for any losses caused by any unauthorized use of your account.
You may use the Site or Services to enter personal information, including without limitation, your name, home address, telephone number, the names of additional household members (each, a “Household Member”), and health and special needs information of yourself and Household Members (collectively, “Information”). You represent that you are authorized to provide all Information.
You agree the Information you provide to us will be true and accurate and kept up to date by you. It is your responsibility to keep your Information current. You agree not to enter false information or impersonate any other person when you use the Services. You must be 18 years of age or older to open an account.
You acknowledge that the Site and all software, applications, interfaces, source code, services, products, systems, trademarks, content and related intellectual property displayed or provided through or in connection with the Site (collectively, the “Services”) are owned by Locality Media, Inc. You agree not to, and agree not to assist or permit any third party to, copy, publish, resell, sublicense, alter, modify, reverse engineer, disassemble, decompile, translate, interfere in the operation of, or make any derivative works from, any of the Services.
THE SERVICES, INCLUDING THE SOFTWARE AND THE SITE, MAY INCLUDE TECHNICAL OR OTHER MISTAKES, INACCURACIES OR ERRORS. COMMUNICATIONS OF YOUR INFORMATION MAY BE INTERRUPTED OR CORRUPTED DURING TRANSMISSION. OUR SYSTEMS MAY NOT PREVENT THE CORRUPTION OR LOSS OF YOUR INFORMATION. THE SERVICES MAY NOT BE COMPATIBLE WITH USER COMPUTER SYSTEMS, DEVICES OR ACCESSIBLE TO YOU OR OTHER USERS AT ALL TIMES. WE ASSUME NO LIABILITY FOR SUCH INCIDENTS OR CONDITIONS. ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTY OF NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR (II) SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOU AGREE WE SHALL HAVE NO LIABILITY OR RESPONSIBILITY FOR THE USE OF YOUR INFORMATION BY MUNICIPAL SERVICES. YOU FURTHER UNDERSTAND AND AGREE THAT MUNICIPAL SERVICES ARE UNDER NO OBLIGATION TO USE OUR SITE OR SERVICES OR YOUR INFORMATION IN CONNECTION WITH THE PERFORMANCE OF THEIR SERVICES AND FUNCTIONS. ENTERING YOUR INFORMATION HERE DOES NOT CREATE ANY NEW OBLIGATIONS ON THE PART OF ANY MUNICIPAL SERVICES.
You agree to indemnify and hold harmless Locality Media, Inc., its subsidiaries, affiliates, directors, officers, employees, and agents, from and against any and all liabilities, damages, losses, costs or expenses (including reasonable attorneys’ fees) arising from or relating to any third party claim, action or demand asserted against any of the foregoing parties based on: (a) any breach of these Terms by you or anyone accessing the Services using your login credentials; (b) any violation of law, regulation or third party rights in connection with your use of the Services; (c) our reliance on instructions from you or Information in your account; or (d) any complaint by a Household Member.
These Terms shall be governed by and construed in accordance with the laws of the State of New York.
Should any part of these Terms be rendered or declared invalid by a court of competent jurisdiction, such invalidation of such part or portion of these Terms should not invalidate the remaining portions thereof, and they shall remain in full force and effect.
